In reply to your Confidential Despatch of the
6th. April, I have the honour to inform you that the proposals made in the letter from the Department of Commerce and Labour at Washington, dated the 6th. March last, do not meet the wishes of this Government for the following reasons:-
(a.) This Government is concerned only with those de-
-portees who have a criminal record and it is not clear whether the phrase "Chinese deported under Court orders" includes Chinese deported by the Department of Justice as well as those deported by the Department of Commerce and Labour, or refers only to rejected Chinese immigrants who have un- -successfully contested in the Courts the order for their deportation.
(b.) In the case of criminals deported to Canton, even if
it is possible to furnish them with through tickets to Canton (which is doubtful), trans-shipment in Hongkong would always be necessary: and, in the event of a deportee refusing to trans-ship, neither the American Consul-General at Hongkong nor the Colonial Police could prevent the deportee from dis- -embarking in Hongkong or insist on his taking ship
for Canton.
